Corporation seeks damages for breach of contract

BELLEVILLE — An Illinois corporation claims a business partner breached its contract.

Keeley & Sons Inc. filed a suit against Created By Dina, Inc., CBD Fabrication and Supply Inc. and CBD Fabrications Inc., and Dina M. Colombo-Gay, and Andy Whetsell in the St. Clair County Circuit Court on Sept. 1.

According to the complaint, the plaintiff was part of a Purchase Order agreement. The suit states that the plaintiff paid what they were required to but CBD wrongfully retained more than $150,000. The suit explains that when the plaintiff tried to make contact with the defendant about the missing payment, the defendant made excuses about why the payments could not be delivered.

The defendant is accused of breach of contract and promissory fraud, in addition to conversion of funds and breach of fiduciary duty.

Keeley & Sons is seeking an unspecified amount in damages. 

The plaintiff is represented by Heidi L. Eckert of Clayton, Missouri.
