Passenger alleges driver crashed into railroad crossing sign

BELLEVILLE — A passenger is suing a motorist for allegedly crashing into a railroad crossing sign.

Nicholas B.Fischer filed a complaint on Oct. 7 in St. Clair County Circuit Court against Samuel Mitchell, alleging that the motorist breached his duty to exercise reasonable care and caution for the safety of others.

According to the complaint, the plaintiff alleges that on Nov. 28, 2015, he was a passenger in an automobile being operated by Mitchell when the defendant drove into a railroad crossing signal, severely injuring the plaintiff.

The plaintiff alleges Mitchell operated his vehicle while under the influence of alcohol, drove the vehicle at a speed greater than reasonable and failed to maintain proper control of the vehicle.

The plaintiff requests a trial by jury and seeks damages in excess of $50,000, plus costs of this suit. He is represented by Steven Giacoletto of Giacoletto Law Firm in Collinsville.
