3M Company, dozens of others accused of liability for benzene exposure

EDWARDSVILLE — A woman diagnosed with acute myelogenous leukemia and her husband are suing several companies, alleging that they bear responsibility for her alleged exposure to benzene and benzene-containing products.

Montana residents Cynthia Davidson and David Davidson filed a complaint on Oct. 3 in the Madison County Circuit Court against 3M Company, Akzo Nobel Coatings, Inc., Akzo Nobel Paints, LLC fka The Glidden Company, Ashland Chemical Company, BP Amoco Chemical Company, BP Corp. North America, Inc., BP Products North America, Inc., BNSF Railway Company, Chase Products Company, Chevron U.S.A., Inc., CH2M Hill Engineers, Inc., f/k/a Lockwood Greene Engineers, Inc., Citgo Petroleum Corporation, Conocophillips, Co., E.I. DU Pont De Nemours and Company, Exxon Mobil Corporation, First Chemical Corporation, A Dupont Chemical Company, Henkel Corporation a/k/a Henkel Loctite Corporation, Huntsman Petrochemical, LLC., International Paint, Inc., International Paint LLC, Jacobs Industrial Services, Inc., a/k/a Jacobs Construction Services, Inc., a/k/a Jacobs Sverdrup Constructors, Inc., Marathon Oil Company, Mooney Painting, Inc., Pharmacia Corporation, individually and as successor in interest to Monsanto Company, Radiator Specialty Company, Rust-Oleum Corporation, Shell Chemical LP, f/k/a Shell Chemical Company, Shell Oil Company, Sigma Coatings, Inc., Soco West, Inc., a/k/a Brenntag West, Inc., a/k/a Dyce Chemical, Inc. Turtle Wax, Inc., Union Oil Company of California, d/b/a Unocal, Union Pacific Railroad Company, United States Steel Company and The Valspar Corporation, citing alleged liability in connection with products containing benzene.

According to the complaint, the plaintiffs allege that in 2014, Cynthia Davidson was diagnosed with acute myelogenous leukemia that they attribute to benzene exposure. The plaintiffs hold the defendants responsible for allegedly failing to implement proper safety measures.

The plaintiffs seek judgment against the defendants for compensatory damages in an amount in excess of $50,000 plus court costs and any further relief this court grants.
