Patient accuses lift manufacturers of product liability

EDWARDSVILLE — A Vandalia man is suing lift manufacturers, alleging they designed a defective lift mechanism. 

Gary Krutsinger filed a lawsuit Aug. 1 in Madison County Circuit Court against T.H.E. Medical Inc., Jorens Healthcare LLC and Recovercare LLC, alleging design defect and failure to warn. 

According to the complaint, on Aug. 1, 2014, as Krutsinger was using the lift at Vandalia Rehabilitation, he fell and sustained injuries to his leg when a bolt broke and the lift strap came off the lift. The suit says Krutsinger suffered substantial medical and rehabilitation expenses, pain and suffering, plus lost wages and income. 

The plaintiff alleges the defendants failed to manufacture a lift that can withstand the anticipated physical abuse of using the mechanism, concealed and misrepresented that the lift was free from defects and failed to disclose that the the lift posed serious safety hazards.

Krutsinger seeks a trial by jury, judgment of more than $75,000, plus court costs and all relief the court deems just and proper. He is represented by attorney Christopher R. Dixon of Dixon Injury Firm in St. Louis.
