Passenger accuses trucking operators of negligence

BELLEVILLE — A Livingston woman is suing drivers of a car and a truck, alleging their negligence caused a vehicle crash that injured the plaintiff.

Jill A. Williams filed a lawsuit July 11 in St. Clair County Circuit Court against William E. Mackley, doing business as a Bill Mackley Trucking, and Ronald E. Elkins, alleging negligence in failing to operate a car and tractor trailer with ordinary and reasonable care.

According to the complaint, on May 27, 2015, Williams was a passenger in a car driven by Elkins traveling westbound on Collinsville Road at the intersection with state Route 111 in Fairmont City while the defendants' tractor trailer was coming from the opposite direction. The suit says the tractor trailer suddenly turned left and collided with plaintiff's vehicle.

The crash, the lawsuit states, caused Williams to suffer pain, incur medical expenses, lost wages, diminished earnings and disability. 

The plaintiff alleges the defendants failed to keep proper lookout, failed to keep the vehicle under control, failed to yield right of way, and failed to obey traffic control signal.

Williams seeks trial by jury, judgment of more than $50,000 against each defendant, costs of suit and such other relief the court deems and proper. She is represented by attorney Eric J. Carlson of Byron, Carlson, Petri & Kalb LLC in Edwardsville.
