Trucker from Troy accused of negligence

EDWARDSVILLE — A motorist is suing Roy J. Vining, a Troy resident, claiming the defendant negligently operated a tractor-trailer, which allegedly led to a collision.

Terence Boyce filed a complaint on May 26 in Madison County Circuit Court against Vining, alleging that the defendant failed to keep his vehicle under control at all times.

According to the complaint, the plaintiff alleges that on January 16. 2015, the vehicle he was operating was stopped in traffic in the right lane of the southbound of I-55 off-ramp to head east on U.S. 67 when the tractor-trailer operated by the defendant struck the rear of his vehicle, causing him severe personal injuries and severe property damage. The plaintiff holds Vining responsible because the defendant allegedly failed to keep proper lookout, operated the vehicle at an excessive rate of speed and failed to stop in a timely manner.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount exceeding $50,000. He is represented by Kari S. Peterson of Onder, Shelton, O'Leary & Peterson LLC in St. Louis, Missouri.
