Bar patron files Dram Shop suit against Alton bar over altercation

EDWARDSVILLE – An Alton resident filed a Dram Shop suit against a local bar after another patron allegedly became intoxicated and caused an altercation.

Marcus Gordon Jr. filed the suit April 19 in Madison County Circuit Court against The New DJ's Bar & Grill Inc. and Shawn B. Barrett. Gordon alleges violations of the Dram Shop Act, willful and wanton conduct, negligence and intentional assault.

According to the complaint, on June 29, 2015, Gordon arrived at the bar located at 2526 College Ave. in Alton. He claims Barrett was also at the bar consuming alcoholic beverages when he allegedly became intoxicated.

Gordon claims Barrett began a verbal altercation using racial slurs and attempting to entice the plaintiff into a physical altercation. Gordon alleges he left the premises and was sitting inside a vehicle when the defendant came out of the bar and allegedly struck the plaintiff in the face, the suit states.

Gordon left the scene and called his father, who told the plaintiff to meet him back at the bar, according to the suit. Barrett continued his verbal assault and became so agitated that he shoved his hands through a window, causing injuries to the plaintiff.

Gordon alleges injuries to his face, chin, arms and hands. He claims he will continue to incur medical bills for treatment of his injuries and has been prevented from attending to his usual duties and affairs, the suit states.

The plaintiff seeks judgment against the both defendants for all four counts in excess of $50,000 plus court costs and other relief the court deems appropriate. He is represented by William E. Miller III in Alton.
