Motorist alleges AAA Insurance won't pay uninsured driver claim

EDWARDSVILLE – A motorist who was injured in a car accident is suing over the insurance company's alleged failure to pay a claim.

Dennis Day filed the suit April 6 in Madison County Circuit Court against Automobile Club Insurance Exchange, doing business as AAA Insurance Company.

On April 7, 2014, Day was driving his vehicle, which was insured by AAA, when he was allegedly injured from an accident with an underinsured driver, the suit states.

Day claims the policy provided underinsured motorist benefits of $250,000 per person and $500,000 per occurrence, according to the complaint.

As a result of the collision, Day alleges he sustained injuries to his back and neck. He claims he demanded arbitration but the defendant has failed to pay benefits to which the plaintiff is entitled and to agree to arbitration or name an arbitrator, the suit alleges.

Day seeks damages against the defendant in an amount in excess of $50,000 for two counts of breach of contract. He further asks the court to declare that the uninsured motorist claim be submitted to an arbitrator of the court's choosing and for other relief the court deems proper.
