Passenger in vehicle claims negligent driver caused her injury

EDWARDSVILLE – The passenger in a vehicle is suing over injuries she allegedly received in an automobile collision.

Cassandra Mikhail filed the suit March 29 in Madison County Circuit Court against Shawn Ebel.

On May 17, 2014, the plaintiff was in Kenneth Kolda's vehicle, which was traveling eastbound on Highway 162 near the intersection with Luehmann Lane, the suit alleges.

Ebel was also driving eastbound when he allegedly struck the passenger side of Kolda's vehicle, causing the plaintiff serious injury.

Mikhail alleges Ebel was negligent for driving at a rate of speed that was high, excessive, dangerous and not safe; failing to exercise ordinary care to keep a lookout; and not sounding any signal of warning.

As a result of the alleged negligent acts, the plaintiff's neck, head and back were seriously injured, she will continue to suffer great physical pain, her injuries are permanent and progressive, and she has incurred medical expenses, the amount of which cannot be determined currently, according to the suit.

The plaintiff seeks judgment in excess of $50,000, plus court costs and other relief the court deems proper. She is represented by Patrick L. Mickey of Brown & Crouppen PC in St. Louis.
