Funeral guest allegedly dies after falling in pothole in church parking lot

BELLEVILLE – An East St. Louis church is being sued after a woman allegedly died from complications of an ankle fracture after falling in a pothole while attending a funeral.

Jermetra Allen, as the personal representative of Mary Butler, filed the suit March 18 in St. Clair County Circuit Court against McCasland Church of God in Christ, alleging premises liability and wrongful death.

On July 29, 2015, the deceased was attending a funeral service at the church, which is located in East St. Louis.

The parking lot owned by the defendant allegedly contained potholes, loose gravel and uneven surfaces, creating a dangerous situation. The decedent allegedly twisted and fractured her ankle when she fell in the lot, according to the complaint.

Then on Aug. 8, 2015, less than two weeks after the fall, Mary Butler died from complications arising from the ankle fracture, the suit alleges.

In addition to a trial by jury, the plaintiff seeks judgment for pecuniary losses, funeral expenses, losses incurred by the deceased between the time of injury and her death, and other relief the court deems just. She is represented by Nuru Witherspoon in Chicago.
