Motorist blames driver, Beverly Farms Foundation for auto collision injuries

EDWARDSVILLE – A Madison County woman is suing a Godfrey driver and a Madison County company, alleging negligence over injuries she says she sustained in an automobile accident. 

Heather L. Miller filed the lawsuit Feb. 16 in Madison County Circuit Court against Daniel D. Morrell and Beverly Farms Foundation Inc., alleging negligence.

According to the complaint, on Feb. 14, 2014, Miller was operating her motor vehicle northbound on Godfrey Road in the village of Godfrey and, at the same time, Morrell was traveling northbound in his vehicle, directly behind the plaintiff. The suit says the defendant failed to reduce his speed or stop and his vehicle struck the back end of the plaintiff's vehicle.

The lawsuit states Morrell was driving the vehicle while working for Beverly Farms Foundation.

The suit says Morell's negligence includes failing to keep a proper lookout, failing to keep the vehicle under proper control, failing to operate the vehicle at a safe speed, failing to reduce the speed of the vehicle in order to avoid an accident, failing to exercise ordinary care for the safety of the plaintiff and disobeying a lawful traffic control device.

As a result of the the defendant's negligence, the lawsuit says, the plaintiff suffered injuries to her neck and spine, she has experienced past pain and expects that to continue into the future, she continues to spend large sums of money for medical care, she will suffer disability and disfigurement into the future, and she continues to endure lost wages.

Miller seeks at least $50,000 from each defendant, plus court costs. She is represented by attorney Craig Jensen of MeyerJensen PC in Alton.
