Motorist blames El Greco pizza driver for her injuries

EDWARDSVILLE – A motorist is suing a Carbondale pizza business and one of its drivers, alleging negligence over injuries she says she received when hit by a pizza delivery truck.

Diane Norris filed a lawsuit Feb. 2 in Madison County Circuit Court against John Palmer, El Greco Inc., and owner Chandrakant Patel, doing business as El Greco Inc., alleging negligence.

According to the complaint, on Feb. 4, 2014, Norris was driving her vehicle westbound on West Main Street near the intersection of North Oakland Avenue in Carbondale while, at the same time, Palmer, in the employ of El Greco, was driving his pizza delivery vehicle directly behind the plaintiff's. The suit alleges Norris' negligence and carelessness caused him to drive his vehicle into the back of the plaintiff's vehicle while it was stopped in traffic.

The lawsuit says Palmer's negligent acts include failing to keep his automobile under proper control, failing to keep a proper lookout, failing to stop his vehicle in time to avoid a collision and failing to properly warn the plaintiff of the impending collision.

As a result of the collision, the suit says, the plaintiff injured her back and neck, has experienced pain and suffering, has experienced loss of a normal life and disability, and will continue to be obligated to pay medical expenses. She also sustained property damage to her vehicle and expenses, the lawsuit says.

Norris seeks judgment against each defendant for at least $50,000, plus court costs. She is represented by attorney Michael P. Glisson of Williamson, Webster, Falb & Glisson in Alton.
