Woman alleges drunk driver pinned her against her front porch, causing injuries

EDWARDSVILLE - A Madison County woman claims she was injured when an alleged intoxicated driver struck her with a truck and pinned her against her porch.

Mary Gipson filed the suit Jan. 15 in Madison County Circuit Court against Kellie Page; Pop's Saloon, doing business as Vera's Tavern; Fredrick L. Grubb Jr.; DJ's Bar & Grill; and Debra Lovell, citing negligence.

According to the complaint, on Jan. 17, 2015, the plaintiff was sitting on the porch steps at the front entrance to her residence. The suit states that Page, driving a pickup truck, struck the plaintiff with the front of the truck, pinning her against the steps of her porch.

The plaintiff alleges the defendant's blood alcohol level was in excess of the legal limit for operating a motor vehicle. She also claims the defendant was speeding, didn't keep her vehicle under proper control, failed to apply the brakes and failed to stop the vehicle, the suit says.

The plaintiff was purportedly injured, necessitating medical care into the future, causing pain and suffering, loss of wages, earning and benefits, and other damages.

Grubb, Vera's Tavern owner, and Lovell, D.J.'s Bar and Grill owner, are both named in the suit under the Dram Shop Act for allegedly selling the plaintiff alcohol, which she allegedly consumed before getting into her vehicle and driving it.

Gipson seeks at least $50,000 plus court costs from each defendant. She is represented by Alan Pirtle and Justin C. Wilson of Brown & Crouppen PC of St. Louis.
