St. Louis County man sues estate of motorist who allegedly caused accident

EDWARDSVILLE, Ill. – A St. Louis County man is suing the estate of a woman who allegedly caused a motor vehicle accident, resulting in injury to him.

William H. Weisberg filed the suit on Jan. 4 in Madison County Circuit Court against the estate of Christina M. Martinez.

On March 9, 2014, the plaintiff was operating a motor vehicle eastbound on McAdams Parkway in Madison County. The defendant was also driving eastbound behind the plaintiff's vehicle when she allegedly collided with the rear of the plaintiff's vehicle. The collision allegedly pushed the plaintiff's vehicle approximately 100 feet east of the intersection.

The defendant's alleged negligence and carelessness resulted from her speeding and failing to reduce her speed, failing to keep a proper lookout, failing to sound a warning of her approach or to slow down, and driving while under the influence of alcohol and drugs, the suit says.

The plaintiff allegedly has spent nearly $10,000 on medical expenses and expects to spend more in the future. He allegedly has sustained loss of mobility, pain and suffering, mental anguish, and loss of the pleasures of life.

The plaintiff seeks at least $50,000 plus court costs, and other relief the court deems appropriate and just. He is represented by Julia M. Kerr of Brown & Crouppen PC of St. Louis.
