Customer alleges O'Reilly Auto Parts' negligence caused him to fall on ice

An Illinois man is suing O'Reilly Auto Parts, alleging a slip and fall on ice outside the defendant's store in Collinsville caused him injury.

Timothy Rose filed the lawsuit Dec. 29 in Madison County Circuit Court against O'Reilly Auto Parts, alleging negligence

According to the complaint, on Jan 7, 2014, Rose was at the defendant's store in Collinsville. He claims that when he walked out to leave he slipped and fell on ice.

The suit says the defendant failed to provide for a safe entrance and exit, failed to maintain the property, failed to warn the public of the unsafe condition caused by the ice, was careless and negligent in maintaining the property and did not keep up with the icy conditions.

The plaintiff alleges he was injured as a result of the fall.

Rose seeks at least $50,000, plus court costs. He is represented by attorney Grey Chatham Jr. of Chatham & Baricevic of Belleville.
