Handicapped patient sues Fairview Heights psychiatric practice over fall

A Breese man is suing two physicians and their Fairview Heights practice, alleging he was injured when he slipped and fell at the end of a handicap ramp.

Eddie McCandrew filed a lawsuit Nov. 13 in St. Clair County Circuit Court against Dr. Thomas V. Jose and Dr. Phillip Dennis, doing business as Neuropsychiatric Partners in Fairview Heights.

According to the complaint, on Sept. 23, McCandrew was exiting the physicians' office and proceeded down the handicap ramp. He allegedly slipped and fell at the end of the ramp, the suit says. He claims the bottom two boards had rotted away from the framing and were protruding from one end.

The lawsuit states the plaintiff was immobilized by the fall and injured his eye, neck, shoulder and low back, causing pain and suffering, the suit says. 

The suit further alleges that once medical personnel were notified of the situation, none came to the plaintiff's assistance, except for water that a nurse practitioner offered him. The nurse practitioner also removed the protruding boards but only after the fall happened, the suit says.

McCandrew seeks a trial by jury, relief of more than $50,000, damages to compensate him for the physical injuries and other relief the court deems proper and just. He is representing himself.
