Mother alleges two motorists caused accident that injured her children

A Madison County mother and her minor children are suing two motorists, alleging negligence over a motor vehicle accident that she says injured all three.

Julianne M. Dant, on behalf of herself and her minor children Kalianne Gibbs and Gavin Gibbs, filed a lawsuit on Dec. 10 in Madison County Circuit Court against Will Carpenter and Jake Simpson. 

According to the complaint, on Sept. 11, Carpenter was driving on state Highway 40 near St. Jacob. Passengers in the vehicle included the minor plaintiffs. Simpson, the suit says, was also driving on Highway 40 but directly in front of Carpenter's vehicle.

The suit states Carpenter's car collided with the rear of Simpson's vehicle due to Carpenter's failure to yield the right of way, keep a proper lookout, drive at a reasonable speed and obey a traffic device. 

As a result of Carpenter's driving, the suit says, the minors were severely and permanently injured and suffered impairment, which may be permanent in nature.

Dant alleges the same damages, including having to pay past and future medical bills, lost wages and lost earning capacity. 

Dant and her children seek a judgment of at least $50,000 from each defendant. They are represented by attorney Brian M. Wendler of Wendler Law PC in Edwardsville.
