Three family members allege another member caused Smithton auto accident

Two Illinois men and two minors are suing a family member, alleging the defendant caused an automobile accident that injured three of them.

Connor J. Burns and Eric M. Burns, minors, through their father Daryl R. Burns Jr., and Daryl R. Burns III filed a lawsuit on Nov. 20 in St. Clair County Circuit Court against Alexander W. Burns.

According to the complaint, on Nov. 28, 2013, the minor plaintiffs and plaintiff Burns III were passengers in a vehicle operated by Alexander Burns on Schmidt Road in the township of Smithton. The vehicle the three plaintiffs were riding in allegedly left the roadway and overturned, causing them to be tossed within the vehicle and suffer injuries. 

The lawsuit states the accident resulted in the three plaintiffs seeking medical attention. The suit seeks recovery of those expenses under the Illinois Family Expense Act.

The plaintiffs seek at least $50,000 each, plus court costs and attorney fees. They are represented by attorney Jason R. Caraway of Kolker Law Offices PC in Belleville.
