An Illinois woman is suing another motorist, alleging negligence after her vehicle was struck from behind.
Jessica Hutcherson filed a lawsuit on Nov. 25 in St. Clair County Circuit Court against Richard C. Martin.
According to the complaint, on Nov. 30, 2013, Hutcherson was operating her vehicle on South Main Street in O'Fallon when Martin allegedly drove into the back of her car.
The suit says his negligence included failure to keep his vehicle under control, failure to look out for other vehicles, failure to stop in time to avoid a collision and driving without safe brakes.
Because of these actions, the lawsuit states, the plaintiff sustained serious and permanent injuries, suffers from mental pain and anguish, has paid money for medical expenses and has had her future earning capacity damaged.
Hutcherson seeks at least $50,000, court costs, a six-person jury trial and attorney fees. She is represented by attorney John E. Lee IV of AuBuchon & Lee LLC in Belleville.
