Granite City denies liability in suit alleging man fell in sewer

Granite City has denied the allegations raised against it in a man’s lawsuit alleging he stepped on an insufficient manhole cover and fell in the sewer.

According to Andrew Flood’s July 28 lawsuit, he claims he was in a vehicle accident at Maryville and Edwardsville roads in Granite City on March 20. While waiting for police to arrive, Flood claims he stopped “on top of a sewer manhole cover, which then flipped, causing plaintiff to fall into the sewer hole.”

Flood alleges the defendants placed a cover that was too small over the hole and failed to secure the cover, maintain a safe sewer system, warn pedestrians about an unsafe condition and properly maintain its system.

Flood seeks damages of more than $50,000, plus costs.

Granite City answered the complaint on Sept. 8 through attorney Ronald Roth of the Roth Law Offices in Granite City, denying the allegations against it.

The plaintiff is represented by Bruce R. Cook of Cook, Ysursa, Bartholomew, Brauer and Shevlin Ltd. in Belleville.
