Our Health Club and Spa sued over alleged faulty toilet

A couple is suing a Glen Carbon gym after the wife was injured when the toilet she was sitting on allegedly came loose from the floor.

Paula and Michael Homan filed a complaint on Aug. 19 in Madison County Circuit Court against Our Health Club and Spa LLC.

According to the complaint, on June 26, Paula Homan was at the defendant's fitness center at 4 Cougar Drive in Glen Carbon, when she went into the women's locker room.

While in a bathroom stall, she claims she attempted to sit on the toilet when it came loose from its base, causing her to fall to the floor.

The defendant is cited with failing to provide a safe restroom, properly inspect the toilets, learn if their plumbers were competent, warn Homan about a hazardous condition, tighten the bolts to the proper torque and hire qualified plumbers.

As a result, Paula Homan suffered neck and shoulder injuries, pain and suffering, and medical expenses.

She seeks damages of more than $100,000, plus costs. Her husband, citing loss of consortium, seeks damages of more than $50,000, plus costs.

The plaintiffs are represented by Brian M. Wendler and Ellen R. Burford of Wendler Law PC in Edwardsville.
