A railroad worker is suing his employer over a workplace injury.
Charles Davis filed a complaint July 28 in St. Clair County Circuit Court against Union Pacific Railroad Co.
Davis, as a carman for Union Pacific, was injured at work on Jan. 21 while "attempting to close an outlet gate on a ballast car," the lawsuit states.
The defendant is cited with failing to provide a safe workplace, task and equipment; provide adequate assistance and training, as well as supervision; inspect its equipment; replace a defective outlet gate; and wait until Davis had the proper training to perform the task.
As a result, the lawsuit states, Davis suffered injuries to his back, hips and spine, pain and suffering, and medical expenses.
The plaintiff seeks damages of more than $50,000, plus costs.
The plaintiff is represented by Jerome J. Schlichter and Nelson G. Wolff of Schlichter, Bogard and Denton in Belleville.
