A Madison County woman is suing a Collinsville tree service company regarding a 2014 motor vehicle accident which the plaintiff claims she was injured when unsecured contents on a trailer spilled onto the road.
Joyce Anderson filed a lawsuit on July 28 in Madison County Circuit Court against Charles Howe and Terry King, doing business as T & T Lawn & Tree Service, alleging that the defendants were negligent in operating a motor vehicle in November 2014.
According to the complaint, Joyce Anderson was a passenger in a 2002 Dodge Neon driven by Olivia Anderson on or about Nov. 19, 2014, in a northbound direction on Maryville Road in the city of Maryville.
The suit states that when Charles Howe was operating a 1999 Chevrolet truck pulling an attached trailer containing tree limbs and logs in his capacity as an employee of King and T & T, several logs fell off the trailer, causing the plaintiff’s vehicle to drive over them.
The defendants are accused of neglecting to secure the trailer’s contents, failing to prevent the trailer load from dropping off the rig, and driving too fast for traffic conditions.
Anderson asserts that she suffered internal and external injuries, including striking her head violently as well as other body parts, when the vehicle she was riding in encountered the debris. She alleges pain, anguish, disability, loss of a normal life, and medical expenses. It was not stated whether the plaintiff was wearing a seat belt.
Anderson seeks judgment in her favor for more than $50,000 plus attorneys’ fees and costs. She is represented by Michael Glisson of Williamson, Webster, Falb & Glisson in Alton, and John W. Hoefert Jr. in Godfrey.
