A couple is suing McDonald's, alleging negligence in a slip and fall that they claim caused injuries.
Shanai A. McLorn and Darryl Garner filed a lawsuit July 16 in St. Clair County Circuit Court against McDonald’s Corporation, McDonald’s Restaurant, McDonald’s of St. Louis and The Metro East, alleging premises negligence and liability in a 2014 incident.
According to the lawsuit, on Feb. 22, 2014, the plaintiffs were at the defendants’ franchise in Fayette County when McLorn lost her balance while walking on the tile floor due to a loose tile which “had been loose for a considerable period of time.”
The suit says she fell to the floor, experienced pain and suffering, and has incurred medical bills as a result of her injuries.
The lawsuit says McLorn sustained severe and permanent damage, which she attributes to the defendants’ negligence. She alleges loss of income and disfigurement.
The suit states McDonald’s failed to maintain the floor in a safe condition, place a sign or other warning in the area to alert patrons, and failed to barricade the dangerous zone. The plaintiff alleges loss of support and services to her husband.
McLorn and Garner seek more than $50,000 plus attorney fees and costs. The couple is represented by attorneys Brian Wendler and Ellen Burford of Wendler Law in Edwardsville.
