Alton hospital and employee sued over collision

A Madison County couple is suing an Alton hospital and its employee, alleging negligence in an automobile accident that they say resulted in permanent injuries.

John J. Zini Jr. and Brenda S. Zini filed a lawsuit on July 13 in Madison County Circuit Court against Alton Memorial Hospital and Justin L. Chapman, alleging vehicular negligence in a 2013 two-vehicle crash.

According to the complaint, on Aug. 8, 2013, a vehicle driven by Chapman in the scope of his employment with the hospital collided with John Zini as he operated his own vehicle in Alton, causing Zini internal and external injuries resulting in disability and disfigurement.

The suit states Chapman and his employer were in breach of their duty of ordinary care to the plaintiffs and were guilty of negligence when the driver failed to yield the right of way, keep a proper lookout for other vehicles on the roadway, pay attention while driving and brake properly to avoid the collision.

The plaintiffs allege John Zini has suffered pain and mental anguish, that they have collectively suffered a loss of future earnings and incurred medical bills, and loss of consortium.

The Zinis seek more than $50,000, plus attorney fees and costs. They are represented by attorney Gregory Tobin of Pratt & Tobin in East Alton.
