A Madison County couple is suing an auto repair and towing business and its individual owners on claims of vehicular negligence following a 2015 crash between the plaintiff’s motorcycle and the defendants’ motor vehicle.
Robert Mayberry and Michelle Mayberry filed a lawsuit on July 16 in Madison County Circuit Court against Arthur Heck, Chuck Heck’s Auto Repair & Towing Inc., doing business as Chuck Hecks Auto Repair & Tow; and Darlene Heck, doing business as Chuck Hecks Auto Repair & Towing and doing business as Chuck Hecks Auto Repair & Tow, alleging acts of negligence in a June 2015 accident at a Madison County intersection.
The suit states that Robert Mayberry was operating his motorcycle heading west on Ferguson Avenue at its intersection with Third Street in Wood River on or about June 9 with Michelle Mayberry riding on the motorcycle as a passenger.
According to the filing, Heck struck the couple when he failed to yield at the stop sign posted at the intersection for southbound traffic. The suit states that the defendant failed to keep a proper lookout, control his vehicle, obey a stop sign and yield the right of way.
The plaintiffs claim pain, suffering, lost wages, disfigurement, medical bills, and loss of consortium. Seeking judgment of more than $50,000, attorney’s fees and costs, they are represented by Jane Unsell of Unsell, Schattnik & Phillips in Wood River.
