Woman sues over rear-end collision in Glen Carbon

A Madison County woman is suing a driver she claims caused a Glen Carbon collision in 2013.

Elizabeth J. Burhans of Belleville filed a lawsuit on July 15 in Madison County Circuit Court against Barbara M. Carnahan on allegations of vehicular negligence in an August 2013 rear-end collision.

According to the filing, Carnahan collided with the back of Burhans’ vehicle on or about Aug. 23, 2013, allegedly violating her duty of ordinary care in the operation of her vehicle. The lawsuit does not specify the exact location of the accident or the circumstances surrounding the alleged rear-end crash.

The suit states that the defendant was guilty of negligence when she drove while distracted, followed the plaintiff’s car too closely, and failed to keep a sufficient lookout for other vehicles on the roadway, apply her brakes properly and reduce her speed.

Court documents indicate that as a direct and proximate result of the defendant’s alleged acts of negligence, the plaintiff sustained external and internal injuries resulting in pain, anguish, disability and disfigurement, along with loss of wages, diminished potential earnings and medical expenses.

The plaintiff seeks judgment in her favor for more than $50,000 plus attorney’s fees and costs. Burhans is represented by Gregory Tobin of Pratt & Tobin in East Alton.
