Woman sues driver who allegedly crashed into her vehicle outside IHOP

A driver is suing another motorist who allegedly crashed into the back of her vehicle in the parking lot of an O'Fallon restaurant.

Barbara Deckard filed a complaint on June 17 in St. Clair County Circuit Court against Amber Gilbertson of O'Fallon.

On Jan. 1, 2014, Deckard claims she and Gilbertson were in their vehicles in the parking lot at the International House of Pancakes at 1028 W. Highway 50 in O'Fallon.

At that time, Gilbertson allegedly rear-ended Deckard, causing her injuries to her lower back, abdomen and right leg, as well as pain and suffering, and medical expenses, the suit states.

The defendant is accused of negligence by driving without adequate brakes and failing to keep a proper lookout, keep her vehicle under control, reduce her speed, stop in time to avoid a crash and apply her brakes in time.

The plaintiff seeks damages of more than $50,000 plus attorney's fees and court costs.

The plaintiff is represented by Jeffrey A. Kopis of the Kopis Law Office in Belleville.
