Injured worker alleges retaliatory discharge

A Randolph County man is suing his St. Clair County employer, alleging unlawful termination following a workplace accident for which he sought workers' compensation.

Harold Cowell of Red Bud filed a lawsuit June 26 in St. Clair County Circuit Court against Auction Broadcasting Co., doing business as a ABC St. Louis (“ABC”) of Centreville, alleging an unlawful dismissal in May following his work injury claim.

According to the filing, on April 8 Cowell injured his neck and back while in the scope of his employment with the defendant. The suit says he properly informed his employer and sought medical treatment for his injuries.

The lawsuit states that Auction Broadcasting terminated Cowell on May 1, in violation of the Worker’s Compensation Act, 820 ILCS and federal employment law.

Cowell seeks judgment in his favor for punitive and exemplary damages in excess of $50,000 plus attorney fees and costs. He is represented by attorneys Mark Scoggins, Clay St. Clair, and Anthony Gilbreth of Crowder & Scoggins in Columbia.
