A St. Clair County man is suing a motorist, alleging negligence for injuries he claims resulted from an automobile accident in Fayetteville.
Dwayne R. Mulholland of Marissa filed a lawsuit on June 10 in St. Clair County Circuit Court against Taylor L. Koeller, also of Marissa, alleging vehicular negligence in a 2014 accident.
According to the complaint, on Aug. 13, 2014, Koeller was traveling west on Venedy Road in Fayetteville Township when she allegedly failed to yield the right of way at an intersection. Mulholland was allegedly headed north on state Route 15. The suit states that Koeller’s sudden approach caused Mulholland to lose control of his semi-truck and run off the roadway.
The plaintiff claims Koeller was negligent in failing to keep a proper lookout and yield the right of way to oncoming traffic, including Mulholland’s vehicle, as she entered the highway from a private road.
The complaint states that the plaintiff sustained injuries to his head, neck, back and general body and endured medical expenses, pain and suffering, and lost wages and future earning capacity.
Mulholland seeks damages in excess of $50,000, plus attorney fees and costs.
