Injured biker accuses driver of crossing the line

A Madison County man filed a complaint against a motorist alleging vehicular negligence in a collision that allegedly left him with serious injuries.

Zachary McElroy filed a lawsuit June 18 in Madison County Circuit Court against James Doty Jr. claiming negligence in a January 2014 crash in Granite City.

According to the filing, the plaintiff was operating his motorcycle on Century Drive on or about Jan. 1, 2014, when the defendant allegedly crossed the center line of the road and struck the biker.

The suit states that Doty was in breach of his duty of care and guilty of negligence by crossing the center line, driving while distracted, and failing to keep a proper lookout for motorcycles, control his vehicle and stay in his lane.

The plaintiff alleges external and internal injuries resulting in disability and disfigurement as a direct and proximate result of the defendant’s alleged negligence.

Claiming lost wages and earning capacity, medical expenses, pain and anguish, McElroy seeks judgment in his favor for damages in excess of $50,000 plus attorney’s fees and costs. He is represented in the case by Gregory Tobin of Pratt & Tobin in East Alton.
