A man claiming he was injured when he was attacked while playing in a charity kickball tournament has demanded a trial by jury.
According to the complaint filed Sept. 20, Timothy Duffin claims he was attending a charity kickball tournament at Lenjo’s Tavern in Pocahontas on Sept. 29, 2012, when defendant Ronald G. Kuper allegedly struck him in the face, breaking his jaw.
Prior to the attack, Kuper allegedly drank alcoholic beverages, the suit claims.
“Ronald G. Kuper struck plaintiff Timothy Duffin without cause and provocation,” the suit states.
Duffin partially blames Joseph C. Rakers, doing business as Lenjo’s Tavern, saying it negligently failed to protect him from injuries, failed to provide security for the event, failed to prevent him from being attacked and failed to ensure that Kuper was removed from the premises.
Madison County Circuit Judge Barbara Crowder has been assigned to the case.
Duffin filed a motion for substitution of counsel. Matthew R. Chapman of Becker, Schroader & Chapman in Granite City took over as attorney for the plaintiff.
No attorney has been identified for Rakers.
