Customer who slipped on puddle at Carisilos restaurant seeks default judgment

A woman claiming she suffered knee and leg injuries after falling on a puddle of water at a Collinsville Mexican restaurant has filed a motion for default judgment.

Andrea Mercer filed the motion for default judgment on Nov. 15 through attorney D. Jeffrey Ezra of Ezra & Associates in Collinsville, claiming the defendant was to enter an appearance or file a response with the court by Oct. 17, but still hasn’t fulfilled that duty.

“That as the time allowed by Illinois law has since passed for defendant to answer or otherwise responsively plead and it is therefore, in default,” the motion states.

According to the complaint filed Aug. 29, Andrea B. Mercer claims she was eating at Carisilos Mexican Restaurant on Sept. 3, 2011, when she fell on a puddle of water in the restaurant, injuring her left knee and leg.

Mercer blames the restaurant for causing her injuries, alleging the employees negligently allowed a puddle of water to remain on its premises, failed to remove the puddle, failed to reasonably inspect the premises and failed to properly manage the restaurant.

Mercer seeks a judgment of more than $50,000.
