Manor Court of Maryville sued over resident's fall

A Maryville nursing home is being sued after one of its residents allegedly broke her back after falling in one of the facility's bathrooms.

Richard Schmidt, on behalf of Josefa J. Schmidt, filed a lawsuit Oct. 31 in Madison County Circuit Court against UDI #2 LLC, doing business as Manor Court of Maryville, and Unlimited Development Inc.

According to the lawsuit, Josefa Schmidt was a resident of Manor Court of Maryville in April 2011 when she was left unattended in one of the bathrooms and fell. Her family claims she broke several bones in her back during the fall.

The Schmidts accuse the nursing home and its owner, Unlimited Development, of negligence and of violating Illinois' Nursing Home Care Act. They ask for more than $200,000 in damages for hospital bills and costs of the lawsuit.

Attorney Robert H. Gregory of East Alton represents the Schmidts.
