Customer’s lawsuit against strip club voluntarily dismissed

St. Clair County Circuit Judge Andrew Gleeson has dismissed without prejudice a Washington Park strip club customer's lawsuit alleging he was shot in the parking lot.

In a Nov. 8 order, Gleeson stated that each party would bear its own costs.

According to the complaint filed Aug. 26, Barry E. Tonsor claimed he was a customer of Déjà vu Showgirls-Washington Park LLC, doing business as Larry Flynt’s Hustler Club, on April 22 when the incident occurred. He alleged he was standing in the club’s parking lot when he was shot in the stomach.

He blamed the defendants of failing to provide a safe environment or adequate security to avoid the shooting.

He originally sought a judgment of more than $50,000.

Steven W. Selby of Alton and Craig M. Grummel of Carrollton represent Tonsor.

No attorney for the defendant has been identified.

The plaintiff had filed a motion for voluntary dismissal. Gleeson has set a conference for Dec. 9 at 9 a.m.
