A Collinsville credit union is denying allegations in a customer’s lawsuit claiming she tripped on uneven concrete at the front door.
According to the complaint filed on Aug. 20, Kelly Beard claims she was walking to the entrance of the South Morrison Avenue Scott Credit Union branch on July 17 when she tripped on a section of uneven concrete between the sidewalk and the entryway, the suit states. She alleges she fell, hurting her face and eye.
Defendant Scott Credit Union answered the complaint on Sept. 27 through attorney Timothy J. Wolf of Brown & James in St. Louis denying the allegations.
It also filed affirmative defenses claiming the plaintiff’s damages were caused solely by Beard’s own negligence “in failing to exercise due care for her own safety.”
Scott Credit Union further claims she failed to keep a proper lookout to avoid injury and acted in a negligent or careless manner.
Beard answered the affirmative defenses on Oct. 2 through attorney Bruce R. Cook of Cook, Ysura, Bartholomew, Brauer & Shevlin in Belleville refuting Scott Credit Union’s defenses.
The plaintiff seeks a judgment of more than $50,000.
St. Clair County Circuit Judge Vincent Lopinot scheduled a mandatory status conference for Nov. 25 at 9 a.m.
