Lebanon Avenue accident is subject of suit

Two St. Clair County residents claim they suffered neck and back injuries after a driver rear-ended their vehicle.

Jerry and Paula Massey filed a lawsuit Nov. 4 in St. Clair County Circuit Court against Lawrence Jointer.

In their complaint, the Masseys allege they were traveling east on Lebanon Avenue on Dec. 10, 2011, when Jointer, who was driving in the same direction, rear-ended their vehicle.

In addition to their injuries, the Masseys suffered pain and disability, incurred medical costs, endured emotional and psychological injury and experienced a greatly diminished ability to enjoy life, according to the complaint. They also lost income, the suit states.

The Masseys blame Jointer for causing the collision, saying he negligently drove too fast, failed to keep a proper lookout ahead, failed to warn of his approach and collided with the rear-end of their vehicle.

In their complaint, the Masseys seek a judgment of more than $100,000, plus costs and other relief the court deems just.
