State Farm accused of refusing to pay under-insured claim

A woman and her two children have filed suit against their insurance company after they allege it refused to pay them for damages they sustained in a collision.

Tamera Jo Weber, Kurtis Weber and Michaela Weber claim they were riding in a 2009 Chevrolet Sequoia when an underinsured driver struck the Sequoia on Oct. 16, 2011, at about 8:46 p.m.

At the time of the collision, the Webers had insurance through defendant State Farm Insurance Company, which was supposed to provide underinsured motorist benefits of $100,000 per person or $300,000 per occurrence, according to the complaint filed Oct. 15 in Madison County Circuit Court.

Because of the collision, Kurtis Weber sustained neck and head injuries while Michaela Weber sustained head, neck, back and shoulder injuries, the suit states. In addition, Tamera Jo Weber sustained neck, back and shoulder injuries, the complaint says.

Following the accident, the Webers demanded arbitration of their underinsured motorists claim, but State Farm refused to grant it, according to the complaint. Therefore, the Webers have lost money to which they claim they are entitled.

In their six-count complaint, the Webers are seeking a judgment of more than $150,000, plus other relief the court deems just. They also seek an order declaring that the Webers’ underinsured motorist claim be submitted to a sole arbitrator.
