A Staunton man accused of failing to hold a ladder and causing another man to injure himself after falling 12 feet seeks to transfer the Madison County lawsuit to Macoupin County.
Defendant Jeffrey Scanzoni filed the motion to transfer venue on Sept. 23 through attorney Jane Unsell of Unsell, Schattnik & Phillips in Wood River.
Unsell claims Scanzoni is a resident of Macoupin County and the incident at issue took place at the defendant’s residence.
“Every action must be commenced in the county of residence of any defendant who is joined in good faith and with probable cause for the purpose of obtaining a judgment against him or her and not solely for the purpose of fixing venue in that county,” the motion states.
According to the complaint filed on Aug. 22, plaintiff Stacy Schneck claims he was helping Scanzoni with a siding job at the defendant’s Staunton home on Nov. 14, 2012, when Schneck climbed the ladder. Scanzoni was allegedly supposed to be helping secure the ladder when it gave way, causing the plaintiff to fall 12 feet to the ground.
Schneck blames Scanzoni for allowing the ladder to fall, negligently failing to secure the scaffolding, failing to secure the ladder and failing to use proper equipment to secure the ladder.
Schneck seeks a judgment of more than $50,000.
