Madison County Circuit Judge Andreas Matoesian canceled a jury trial in an Edwardsville police officer’s case against Big Daddy’s and his alleged attackers.
The jury trial was originally scheduled for Nov. 12. However, defendant BubbaSliceBone, Inc. was granted a consent motion to continue on Oct. 8, which had indicated the defendant would not be ready in time for the trial.
BubbaSliceBone, represented by David P. Bub and Brandon B. Copeland of Brown & James, PC in St. Louis, argued in its motion to continue on Sept. 12 that the parties are still engaged in written discovery
Matoesian scheduled a case management conference for Nov. 20 at 9 a.m. to discuss rescheduling the trial.
Officer Andrew J. Feller and his wife, Kimberly Feller, filed the lawsuit against BubbaSliceBone, Inc., also known as Big Daddy’s Edwardsville, and Traig Henson in April.
Feller claims he was called to Big Daddy’s while on duty to break up an altercation in the parking lot when Henson allegedly became intoxicated in the bar and attacked Feller. Feller claims Henson struck him and violently held onto his back, torso, knee and other musculature, the suit states.
Steven J. Siebert, Timothy J. Bauer, James J. Sinovic and Arthur Risavy are also named defendants.
Feller blames Big Daddy’s bar for allegedly allowing visitors to become intoxicated and disorderly and faied to control its guests.
