A man has filed suit against his former employer, alleging he lost his job after he filed for workers’ compensation benefits.
John D. Holder claims he was working for defendant Olin Corporation on Oct. 11, 2011, when he injured his back while working on a forklift.
Following the incident, Holder visited Olin Medical and was sent home on Oct. 12, 2011, according to the complaint filed Oct. 15 in Madison County Circuit Court.
Holder then visited his own doctor, Dr. Crancer, on Oct. 12, 2011, and was taken off work “until further notice,” the suit states. On the same day, Holder notified his boss of Crancer’s note and was told that he would be okay to remain off work, the complaint says.
However, on Oct. 18, 2011, Holder claims he was fired in retaliation for his filing of workers’ compensation benefits.
He says Olin Corporation is guilty of willful and wanton conduct and breached its contract.
In his complaint, Holder is seeking a judgment of more than $100,000 and punitive damages of more than $750,000, plus costs.
