Granite Nursing and Rehab sued on wrongful death claims

The executor of a deceased woman’s estate has filed suit against the nursing home where he claims the woman fell, sustaining head injuries that led to her death.

Charles D. Thomas claims Thelma V. Thomas was living at defendant Granite Nursing and Rehabilitation Center on Dec. 15, 2011, when she fell while she was attempting to move. Because of her fall, Thelma Thomas suffered a subdural hematoma, which is a condition in which blood gathers outside the brain, according to the complaint filed Oct. 2 in Madison County Circuit Court.

Following her fall, Thelma Thomas died, the suit states.

Charles Thomas blames Granite Nursing and Rehabilitation Center for causing Thelma Thomas’s death, saying it negligently failed to help her move, failed to take all reasonable precautions to ensure that Thomas’s environment was as free of accident hazards as possible and failed to develop an up-to-date resident care plan for Thomas.

In addition to Granite Nursing and Rehabilitation Center, Charles Thomas also names Aurora Cares, which owned the facility, as a defendant.

In his complaint, Charles Thomas seeks a judgment of more than $400,000, plus costs and other relief the court deems just.
