Troy law firm sues Holy Cross Hospital over Medicare payments contract

A Troy law firm claims a Chicago hospital has failed to adequately pay it for work it has done to collect extra Medicare payments on the hospital’s behalf.

Jacobson and Associates filed a lawsuit Sept. 19 in Madison County Circuit Court against Holy Cross Hospital.

Jacobson and Associates claims it entered into a consulting agreement with Holy Cross Hospital. In the agreement, Holy Cross agreed to provide information to Jacobson, which Jacobson would use to obtain additional money from Medicare for Holy Cross, according to the complaint. For its services, Jacobson was supposed to receive 20 percent of the additional money it recovered for Holy Cross, the suit states.

Jacobson and Associates has attempted to perform its obligations under the contract, but has not been able to do so to the best of its ability because Holy Cross has failed to provide it with adequate documentation, the complaint says. In addition, except for a payment of $23,655, Holy Cross has failed to pay Jacobson and Associates the amount it is owed for its completed and anticipated performance, the law firm claims.

In its complaint, Jacobson and Associates seeks a judgment of more than $100,000, plus attorneys’ fees, costs and other relief the court deems just.
