Passenger in I-70 rear end accident sues driver

A woman has filed suit against the driver who she claims struck the back of the vehicle in which she was riding.

Lea Midgett claims she was riding in a vehicle traveling east on Interstate 70 near milepost 230 in St. Louis on Jan. 26 when defendant Dale Glenn Jr., who was driving in the same direction, rear-ended her.

Because of the collision, Midgett became sick, sore, lame, disordered and disabled; suffered neck, shoulder and back injuries; and incurred medical costs, according to the complaint filed Sept. 16 in St. Clair County Circuit Court. She also suffered disability, experienced pain and suffering and lost wages, the suit states.

Midgett blames Glenn for causing the collision, saying he negligently failed to keep a proper lookout, struck the back of her vehicle, failed to properly apply his brakes, drove too fast and followed her vehicle too closely.

In her complaint, Midgett is seeking a judgment of more than $50,000, plus costs.

Thomas C. Rich, Kristina D. Cooksey and Michelle M. Rich of Fairview Heights will be representing her.

St. Clair County Circuit Court case number: 13-L-473.
