Trash build-up inside mall causes patron to slip on spilled coffee, suit claims

A Clay County woman claims she sustained lasting injuries after she fell on spilled coffee that had been placed on the top of an overflowing trashcan in the St. Clair Square Mall.

Tammy Venable filed a lawsuit Sept. 11 in St. Clair County Circuit Court against St. Clair Square and ERMC Property Management Company of Illinois.

In her complaint, Venable alleges she was shopping at St. Square Mall in Fairview Heights on Sept. 18, 2011, when she slipped and fell on the spilled coffee.

Because of her fall, Venable suffered diverse injuries, suffered pain, incurred medical costs, lost employment and was prevented from attending to her usual duties, according to the complaint.

She blames the defendants, which ran the mall and the walkways where she was shopping, for causing her injuries, saying they negligently allowed an over-abundance of trash to overflow in a trash can, allowed the trash to pile up over a period of time and invited the public to use the walkway when they knew that it was dangerous to do so.

In her complaint, Venable seeks a judgment of more than $100,000, plus costs and other relief the court deems just.
