A man has filed suit against the driver who he claims struck his vehicle after failing to keep a proper lookout.
James S. Manley claims he was driving south on Summerfield South Road near its intersection with State Route 161 in Mascoutah on Feb. 1 at about 2:32 a.m. when defendant Floyd J. Schmit, who was driving a 2000 Chevrolet Silverado east, struck his vehicle.
Because of the collision, Manley was made sick, sore, lame, disordered and disabled; suffered injuries to his head, brain, back, neck and ribs; and experienced pain and suffering, according to the complaint. He also incurred medical costs, experienced physical pain and mental disability and lost his earning capacity and wages, the suit states.
Schmit negligently failed to reduce his speed to avoid a collision, failed to keep a proper lookout, drove in such a manner so as to strike Manley’s vehicle, drove while under the influence of alcohol and failed to properly apply his brakes, the complaint says.
In his complaint, Manley is seeking a judgment of more than $50,000, plus costs and other relief the court deems just.
