Broken toe, chipped tooth claimed in Belleville rear-end accident

A woman claims she suffered from a broken toe and a chipped tooth after a driver rear-ended her vehicle.

Jyll House filed a lawsuit July 31 in St. Clair County Circuit Court against Betty L. Leppard.

In her complaint, House alleges she drove south on Illinois Route 159 about 104 feet south of W.E. Street in Belleville on Sept. 19, 2011, at about 9:42 a.m. when Leppard, who was driving in the same direction, rear-ended House’s vehicle.

Because of the collision, House became sick, sore, lame, disordered and disabled; suffered extensive injuries to her head, neck, back and left foot; and sustained a broken toe and a chipped tooth, according to the complaint. She also incurred medical costs, suffered disability, experienced pain and suffering, lost wages and suffered from an impaired earning capacity, the suit states.

House blames Leppard for causing the collision, saying she negligently failed to keep a proper lookout, drove in such a manner as to strike the rear of House’s vehicle, failed to properly apply her brakes, drove too fast, followed House’s vehicle too closely and drove without adequate brakes.

In her complaint, House seeks a judgment of more than $50,000, plus costs.

John H. Hustava of Collinsville will be representing her.

St. Clair County Circuit Court case number: 13-L-399.
