A bank has filed suit against the man who it claims failed to repay more than $40,000 he borrowed from it.

Associated Bank claims it lent Paul E. Schmitt $40,000 on Oct. 23, 2004. Since then, however, Schmitt has failed to repay the money, according to the complaint filed July 11 in St. Clair County Circuit Court. He now owes the principal, plus interest and late fees, the suit states.

“The note is substantially past due as follows: principal amount -- $39,069.98, interest to July 3, 2013 -- $20,814.26, late fees -- $12.20, total amount due -- $59,896.44,” the complaint says.

In addition to the money it claims it is owed, the bank is seeking attorneys’ fees, costs and other relief the court deems just.
