A man claims he sustained severe and permanent injuries to his neck and head while working for a railroad company.
Carl L. Sims filed a lawsuit July 16 in St. Clair County Circuit Court against Canadian National Railway Company and Illinois Central Railroad Company.
In his complaint, Sims claims he was working as a trackman for the defendants on July 20, 2012, near Chicago when he was injured while operating a spike puller that was struck by a ballast plow.
In addition to his neck and head injuries, Sims suffered great pain and mental anguish, sustained a greatly impaired earning capacity and incurred medical costs, according to the complaint.
He blames the railroad for causing his injuries, saying it negligently failed to provide safe tools, failed to provide him with proper equipment, failed to provide him with proper personal protective equipment, failed to provide him with appropriate supervision and failed to warn of a hazardous condition, among other negligent acts.
In his complaint, Sims seeks a judgment of more than $50,000, plus costs.
