Man claims foot driven over in elementary school parking lot

A man claims he sustained severe and permanent injuries after a driver ran over his foot while he was dropping his children off at an elementary school parking lot.

John Girard filed a lawsuit June 25 in St. Clair County Circuit Court against Maryn A. Hoskin.

Girard claims he was standing in the parking lot at Estelle Kampmeye Elementary School at 707 North Smiley Street in O’Fallon on Sept. 2, 2011, at about 3 p.m. Girard was dropping off his children and Hoskin was planning to pick them up, according to the complaint.

As Girard was standing near Hoskin’s vehicle, Hoskin drove over his foot, greatly injuring him, the suit states.

In addition to his injuries, Girard incurred medical costs, the complaint says.

Girard blames Hoskin for causing the collision, saying she negligently failed to keep a proper lookout, failed to keep her vehicle under proper control, failed to decrease her speed when she knew that Girard was standing near it and reversed her automobile from a parking spot when she knew it would strike Girard.

In his complaint, Girard seeks a judgment of more than $50,000, plus costs and other relief the court deems just.

Michael P. Murphy and Matthew D. Bigham of Freeark, Harvey and Mendillo in Belleville will be representing him.

St. Clair County Circuit Court case number: 13-L-325.
